General Terms and Conditions (GTC) 1. Scope & Provider 1.1 The online shop under the domain https://www.google.com/search?q=chronenwerk.com (hereinafter referred to as "Shop" or "Platform") is operated by: Daniel Brock, Kurt-Schumacher-Str. 30, 58452 Witten, Germany (hereinafter referred to as "Seller", "we" or "us"). 1.2 These GTC apply to all contracts concluded between consumers (§ 13 German Civil Code) and entrepreneurs (§ 14 German Civil Code) – hereinafter collectively referred to as "Customers" – via the Shop. 1.3 The shop offers a diverse range of products, in particular: Watches and jewelry Nutritional supplements and lifestyle products Toys and accessories 1.4 Any differing, conflicting, or supplementary terms and conditions of the customer shall not become part of the contract unless we expressly agree to their validity in writing. 2. Contractual Partners / Contract Language 2.1 The purchase agreement is concluded exclusively between the customer and Daniel Brock (Chronenwerk), even if the physical delivery of the goods is handled by an external fulfillment service provider. 2.2 The contract language is German. 3. Offer and Conclusion of Contract 3.1 The presentation of the products in the shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order. 3.2 By clicking the button for placing a binding order, the customer submits a binding offer to purchase. 3.3 We accept the offer by sending an explicit order confirmation via email or at the latest by dispatching the goods. 4. Prices and Terms of Payment 4.1 All prices are in euros (EUR) and include statutory VAT. Any applicable shipping costs are clearly displayed during the ordering process. 4.2 For deliveries to non-EU countries (e.g., Switzerland), additional customs duties, taxes, or fees may apply. These are to be borne entirely by the customer. 4.3 Payment processing is handled via connected payment service providers (e.g., Shopify Payments, PayPal, credit card). If prepayment is agreed upon, payment is due immediately upon conclusion of the contract.

5. Delivery, Product Availability & Fulfillment 5.1 The physical storage, order picking, and delivery of goods are partially carried out by external fulfillment partners (dropshipping). 5.2 Should an ordered product be unavailable through no fault of our own, we reserve the right to withdraw from the contract. The customer will be informed immediately, and any payments already made will be refunded promptly. 5.3 We are not liable for delivery delays caused by force majeure or circumstances within the control of the shipping provider or customs authorities, provided that we are not at fault. 6. Retention of Title: The delivered goods remain our property until full payment has been received. 7. Right of Withdrawal and Cost Allocation: 7.1 Consumers have the statutory right of withdrawal in accordance with our separate cancellation policy (14-day period). 7.2 Cost Allocation: If the consumer exercises their right of withdrawal, they bear the direct costs of returning the goods. 7.3 Premature Expiry of the Right of Withdrawal: The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (Section 312g Paragraph 2 No. 3 of the German Civil Code). This applies in particular to opened food supplements and personal care products. 8. Warranty and Liability 8.1 The statutory warranty rights apply (Sections 434 et seq. of the German Civil Code), unless otherwise specified below. 8.2 We are liable without limitation for intent and gross negligence. In cases of simple negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations) and only up to the amount of the foreseeable damage typical for this type of contract. 8.3 Limitations of liability do not apply in cases of injury to life, body, or health, fraudulent concealment of defects, or claims under the Product Liability Act. 9. Product-Specific Information (Dietary Supplements, Toys, Jewelry) To protect both contracting parties, the following information applies to our product ranges and is accepted by the customer upon purchase: Dietary Supplements (DS): The offered DS are not a substitute for a balanced, varied diet and a healthy lifestyle. The recommended daily intake stated on the packaging must not be exceeded. The products must be stored out of the reach of small children. We expressly make no promises of healing or medical advice. A doctor should always be consulted in case of health problems or questions regarding intake. No liability is assumed for individual intolerances or allergic reactions.

  • Toys: The customer must strictly observe the product-related age recommendations and warnings (e.g., choking hazard due to small parts that can be swallowed). The use of toys by small children must always be under adult supervision.

  • Jewelry & Fashion Glasses: Minor variations in color or texture compared to online representations are due to technical reasons and do not constitute a defect. Surface finishes (e.g., gold plating) are subject to natural abrasion, which does not constitute a defect. Fashion glasses without prescription lenses are not medical products.

  • 10. Specific Information and Warranty Exclusions for WatchesThe statutory warranty covers manufacturing and material defects that already existed at the time of delivery. It expressly excludes damage or defects resulting from improper use, lack of care, external influences, or natural wear and tear after the transfer of risk. In particular, the following cases do not constitute a warranty claim:
    • Wear parts: The lifespan of batteries (energy cells) as well as normal wear and tear on wear parts such as straps (leather, textile, rubber, metal), cases or watch crystals (e.g. scratches, material abrasion, discoloration due to sunlight or perspiration).

    • Improper handling: Damage caused by rough handling, drops, impacts, vibrations, strong magnetic fields, extreme temperatures or contact with chemicals (e.g. perfume, cosmetics, cleaning agents).

    • Water damage:Water ingress in watches that are not explicitly classified for their intended use (e.g., at least 10 ATM for swimming). The stated water resistance according to DIN 8310 is not a permanent characteristic, as seals are subject to a natural aging process. Water damage caused by improper handling (e.g., pulling out the crown or operating pushers underwater) is excluded from the warranty.

    • Third-party tampering:Damage resulting from the watch being opened or manipulated by the customer or by third parties not authorized by us (e.g., for improper battery replacement).

    11. Data ProtectionThe collection and processing of personal data is based on the GDPR. The shop is hosted by Shopify Inc. (a data processing agreement is in place). For contract fulfillment, address and payment data are shared with our fulfillment and shipping service providers. Please see our privacy policy for further details.

    12. Dispute Resolution 12.1 The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr 12.2 We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board. 13. Final Provisions 13.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence. 13.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, our registered office (Witten) shall be the exclusive place of jurisdiction for all disputes arising from this contract.
