These Terms of Service (“Terms”) govern your use of the website chronenwerk.com and any purchases you make from us. By accessing the website or placing an order, you agree to be bound by these Terms.

Product descriptions, images, and specifications are provided for informational purposes. Minor variations in color, finish, or appearance due to screen settings or manufacturing tolerances do not constitute a defect.

4. Order Process and Contract Formation

  • Product listings on the website are invitations to make an offer and do not constitute a binding offer by us.
  • By clicking the order button and completing the checkout process, you submit a binding offer to purchase the selected products.
  • We accept your offer by sending an order confirmation email or by shipping the goods.
  • We reserve the right to refuse or cancel any order at our discretion (for example, due to pricing errors, stock unavailability, or suspected fraud).

5. Prices and Payment

  • All prices are displayed in the currency shown on the website and include applicable taxes where required.
  • Shipping costs are calculated and displayed during checkout.
  • For deliveries outside the European Union, additional customs duties, import taxes, or fees may apply. These are the sole responsibility of the customer.
  • Payment is processed through third-party payment providers (e.g., Shopify Payments, PayPal, credit/debit cards). Payment is due immediately upon order placement unless otherwise agreed.

6. Shipping, Delivery & Fulfillment

  • Some products may be fulfilled and shipped by third-party fulfillment partners (including dropshipping).
  • Delivery times are estimates only and are not guaranteed.
  • We are not responsible for delays caused by shipping carriers, customs authorities, or events beyond our reasonable control (force majeure).
  • Risk of loss and title to the products pass to you upon delivery to the carrier or upon delivery to the address you provided, whichever occurs first under applicable law.

7. Returns and Refunds

Returns and refunds are governed by our separate Return & Refund Policy, which is incorporated into these Terms by reference. Please review that policy carefully before placing an order.

8. Ownership Retention

We retain ownership of the products until full payment has been received.

9. Warranty Disclaimer and Limitation of Liability

Disclaimer of Warranties To the maximum extent permitted by applicable law, the products and the website are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • your use of or inability to use the website or products;
  • any unauthorized access to or use of our servers or any personal information;
  • any interruption or cessation of transmission to or from the website;
  • any bugs, viruses, or the like that may be transmitted through the website by any third party.

Our total liability for any claim arising out of or relating to these Terms or the products shall not exceed the amount you paid for the specific product giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

10. Product-Specific Notices (Watches & Jewelry)

The following additional terms apply to watches and jewelry and form part of these Terms:

Watches

  • The statutory warranty (where applicable) covers manufacturing and material defects present at the time of delivery.
  • It does not cover damage or defects caused by improper use, lack of maintenance, external influences, or normal wear and tear after delivery.
  • Specifically excluded from coverage:
    • Wear parts (batteries/energy cells, straps made of leather, textile, rubber or metal, cases, crystals) including normal abrasion, scratches, discoloration from sunlight or sweat.
    • Damage from drops, impacts, shocks, strong magnetic fields, extreme temperatures, or contact with chemicals (perfume, cosmetics, cleaning agents).
    • Water damage on watches not expressly rated for the intended use (e.g., minimum 10 ATM for swimming). Water resistance is not a permanent property and seals age over time. Operating the crown or pushers underwater voids water resistance.
    • Damage resulting from opening or modifying the watch by the customer or any unauthorized third party (including improper battery replacement).

Jewelry

  • Minor deviations in color or structure compared to online images are technically unavoidable and do not constitute a defect.
  • Surface finishes (e.g., gold plating) are subject to natural wear and abrasion, which does not constitute a defect.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

12. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Delaware, and you hereby consent to the personal jurisdiction and venue therein.

Notwithstanding the foregoing, if you are a consumer residing in a jurisdiction that provides mandatory consumer protections that cannot be waived, those protections will apply to the extent required by applicable law.

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the website or placement of orders after any changes constitutes acceptance of the revised Terms.
